Barefoot Vibes Paddleboard School
Introduction
These terms and conditions apply to all lessons and tours provided by Barefoot Vibes Paddleboard School (the “School”) to any person (the “Customer”) who books or participates in any of the School’s services. By booking or participating in any of the School’s services, the Customer agrees to be bound by these terms and conditions. If the Customer is under 18 years of age, the Customer’s parent or guardian must also agree to these terms and conditions on the Customer’s behalf.
Booking, Payment, and Cancellation
· The Customer must book a lesson or tour in advance through the School’s website, phone, email, or in person.
· The Customer must discuss any existing medical condition that may impede their ability to safely take part in the session with the School before booking a lesson or tour.
· The boards used have a maximum rider weight of 100kg (approximately 15st 10lb), any Customer over this weight should contact the School before booking.
· The Customer must provide accurate and complete information when booking, including the Customer’s name, contact details, and any relevant medical conditions or special requirements.
· The Customer must pay the full amount of the booking fee at the time of booking, unless otherwise agreed by the School.
· The School reserves the right to refuse or cancel any booking at its sole discretion, without giving any reason. In such cases, the School will refund the booking fee to the Customer.
· The Customer may cancel or reschedule a booking up to 48 hours before the scheduled start time of the lesson or tour, subject to availability. In such cases, the School will refund the booking fee to the Customer or apply it to the rescheduled booking, as requested by the Customer.
· If the Customer cancels or reschedules a booking less than 48 hours before the scheduled start time of the lesson or tour, or fails to show up for the lesson or tour, the Customer will forfeit the booking fee and will not be entitled to any refund or rescheduling.
· The School may cancel sessions at short notice due to adverse weather conditions or any other technical issues, and in these instances the School will contact you to arrange an alternative date and time, or provide a refund.
Lesson and Tour Conditions
· The Customer must arrive at the designated meeting point at least 15 minutes before the scheduled start time of the lesson or tour, unless otherwise instructed by the School.
· Any Customer under the age of 18 must be accompanied by a responsible adult.
· The Customer must follow the instructions and directions of the School’s staff and instructors at all times during the lesson or tour.
· The Customer must wear the appropriate clothing and equipment provided or recommended by the School, such as a wetsuit, buoyancy aid, helmet, and paddle board.
· The Customer must respect the rights and safety of other participants, staff, instructors, and third parties during the lesson or tour.
· The Customer must not consume any alcohol, drugs, or other substances that may impair the Customer’s ability or judgment before or during the lesson or tour.
· The Customer must be medically fit to participate, be able to swim confidently, be relatively fit, and be to move between kneeling and standing without difficulty.
· The customer must be aware of the risk of waterborne diseases, including Weil’s Disease (leptospirosis), and take sensible precautions including: covering any cuts or scratches with a waterproof covering; If you fall in, take a shower and treat cuts with antiseptic and a sterile dressing; wash wet clothing before you wear it again; and if you develop flu-like symptoms within two weeks, see a doctor and mention that you fell in the water and the risk of Weil’s Disease.
· The Customer must inform the School of any changes in the Customer’s medical condition or special requirements before the lesson or tour.
· The School reserves the right to terminate or modify any lesson or tour at any time, without giving any reason, in the event of adverse weather conditions, safety concerns, equipment failure, or any other circumstances beyond the School’s control. In such cases, the School will offer the Customer an alternative date, time, or location for the lesson or tour, or a partial or full refund of the booking fee, at the School’s discretion.
· The School reserves the right to exclude or remove any Customer from any lesson or tour, without giving any reason, if the Customer breaches these terms and conditions, behaves inappropriately, disrupts the lesson or tour, or poses a risk to themselves or others. In such cases, the Customer will forfeit the booking fee and will not be entitled to any refund or rescheduling.
· The customer is responsible for the care of any of the School’s equipment and the facilities being used during lessons and tours, and any damage done to the School’s equipment or the facilities being used will incur a £100 to cover insurance excess at the School’s discretion.
Liability and Disclaimer
The Customer acknowledges and agrees that stand up paddle boarding is a physical activity that involves inherent risks and dangers, such as injury, illness, drowning, collision, falling, loss or damage of property, and death. The Customer participates in the School’s services at their own risk and responsibility. The Customer waives and releases the School, its staff, instructors, agents, and affiliates from any and all claims, liabilities, damages, losses, costs, and expenses arising from or related to the Customer’s participation in the School’s services, except to the extent caused by the School’s negligence or breach of these terms and conditions. The Customer agrees to indemnify and hold harmless the School, its staff, instructors, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses arising from or related to the Customer’s breach of these terms and conditions, or the Customer’s negligence or misconduct.
The School does not make any warranties or representations, express or implied, regarding the quality, safety, suitability, or availability of its services, or the accuracy, completeness, or reliability of any information or advice provided by the School. The School disclaims any and all liability for any errors, omissions, or inaccuracies in such information or advice. The School’s liability for any breach of these terms and conditions, or any negligence or other tortious act or omission, is limited to the amount of the booking fee paid by the Customer, or the provision of a replacement or equivalent service, at the School’s discretion.
The School takes no liability for the loss or damage of personal belongings or damage to, or theft of, vehicles at the lesson or tour sites.
Privacy and Data Protection
The School respects the Customer’s privacy and personal data. The School collects, uses, and stores the Customer’s personal data, such as the Customer’s name, contact details, and medical conditions, for the purposes of providing its services, communicating with the Customer, and complying with its legal obligations. The School does not share the Customer’s personal data with any third parties, except as required by law, or with the Customer’s consent. The School takes reasonable steps to protect the Customer’s personal data from unauthorized access, use, disclosure, or loss. The Customer has the right to access, correct, update, or delete their personal data held by the School, subject to the School’s verification of the Customer’s identity and the School’s compliance with its legal obligations.
The School may take photos and videos during lessons and tours. Photos and videos are shared via social media and can be download and shared by all participants and the public. If you do not wish to have any of your photos placed on any of our social media pages, please let us know.
Governing Law and Dispute Resolution
These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or related to these terms and conditions, or the School’s services, shall be subject to the exclusive jurisdiction of the courts of England and Wales. The Customer and the School agree to attempt to resolve any dispute amicably and in good faith, before resorting to legal action.
